1. General Terms and Conditions

1.1. The Diamande online shop sells the products (hereinafter: Products) available at the Diamande shops owned by Sansaaro OÜ.

1.2. These Terms and Conditions apply to the legal relations arising between the customer (hereinafter: Customer) and Sansaaro OÜ (hereinafter: Seller), owner of the the online shop at www.diamande.ee (hereinafter: Online Shop). In addition to these Terms and Conditions, the legal relations arising from the purchase of Products in the Online Shop are governed by the legislation of the Republic of Estonia.

2. Prices

2.1. All prices displayed in the Online Shop are given in euros and include the value added tax according to the rate applicable in the Republic of Estonia.


3. Products

3.1. The Products displayed in the Online Shop are generally in stock. However, the availability of the Products may change due to technical issues in the Online Shop’s programmes.

3.2. If the Customer submits an order for a Product and the Product appears to be out of stock, the Online Shop is unable to fulfil the order. An Online Shop employee will contact the Customer to suggest a replacement product or a new delivery time or will refund the payment made by the Customer within 10 days at the latest.

3.3. Images of the Products in the Online Shop are for illustration purposes only and the actual Product may slightly vary.


4. Purchases

4.1. The Customer selects the desired Product in the Online Shop and adds it to the basket by clicking on “Add to basket”.

4.2. To check out the order, the Customer clicks on “Checkout” and is redirected to the checkout page. After entering the details requested, the Customer pays for the Product by bank link service and confirms the order by clicking on “Return to merchant”.

4.3. If the Product is paid, the Online Shop sends an order confirmation to the Customer’s e-mail address.

4.4. The Customer is required to submit true and accurate details when placing an order.

4.5. The Seller is not liable for failure to fulfil the order due to incorrect data provided by the Customer or for any resulting consequences.


5. Payment opportunities

E-store purchases for it

The payment is made via Estonian bank links (Swedbank, SEB, Luminor, LHV, Coop Pank, Pocopay, Liisi ID ja Finora Capital).

Payment is made through Maksekeskus AS, outside the Diamande e-shop environment. The Diamande e-shop does not have access to the buyer's bank account details at any time.

After paying for the goods, please be sure to press the "Return to Merchant" button.


6. Right of withdrawal

6.1. The Customer has the right to replace or return a Product in 14 days. The term of 14 days begins upon receipt of the Product.

6.2. To withdraw from an order, the Customer should send a withdrawal form to the e-mail address info@diamande.ee. The withdrawal form is available here.

6.3. Products are returned according to the same methods used to deliver the Products to the Customer.

6.4. If the Customer uses the return methods provided by the Online Shop, returning the Products is free of charge for the Customer. If the Customer uses any other return methods, the Seller is not required to compensate the transport costs to the Customer.

6.5. The Seller refunds the price of the Product(s) returned, including any delivery costs incurred by the Customer, to the Customer’s bank account in 14 days after receipt of the withdrawal form. The Customer is required to deliver the returnable Products to the Seller in 14 days after submitting the withdrawal form. If the Seller has not received the Products within this deadline, the refund date is extended until the day when the Seller receives the Products. A returned Product may not be used or the factory seal damaged, and it may not be dirty or show any other signs of use. The Product must be complete (with the packaging and all items included in the packaging – user manual, certificate, etc.).


7. Procedure for claims

7.1. According to § 218 (2) of the Law of Obligations Act, the Products sold in the Online Shop are subject to a 2-year period for claims. Any disputes arising between the Customer and the Seller will be resolved by negotiations.

7.2. If any deficiencies occur, the Customer will have the right to address the Online Shop in two months at the latest by sending an e-mail to info@diamande.ee 

7.3. In case of any deficiencies in the Products purchased from the Online Shop which are the liability of the Seller, the Seller will repair or replace such defective Products. If it is not possible to repair or replace the Products, the Seller will refund to the Buyer all expenses incurred under the sales contract.

7.4. The Seller responds to any claims filed by the Customer at the first opportunity, but in 15 days after receipt of a claim at the latest.

7.5. According to § 222 (1) of the Law of Obligations Act, the Customer has the right to demand the repair or replacement of a Product if the Product does not conform to the contract. If the Product does not conform to the contract, the Seller will bear the costs of repairing or replacing the Product, in particular, transportation, post, labour, travelling and material costs. 

7.6. The Seller is not liable for any damages caused by abnormal use of the Products ordered and for any delays in delivery if such damages or delays are caused by circumstances which the Seller could not have affected and/or which have been caused by circumstances beyond its control (force majeure).


8. Liability

8.1. The Seller and the Customer are liable to each other for any damages caused to the other party by violation of these Terms and Conditions, in the cases and to the extent provided for in the legislation of the Republic of Estonia.

8.2. The Seller is liable to the extent of the sales price of a Product.

8.3. The Customer undertakes to use the Online Shop service only for the purposes that are in conformity with the law and good practice.


9. Terms and Conditions, and changes

9.1. By registering in the Online Shop or making a purchase, the Customer agrees to the Terms and Conditions of the Online Shop and undertakes to comply with them.

9.2. The sales contract between the Seller and the Customer enters into force upon receipt of the purchase amount on the Seller’s bank account.

9.3. The Seller has the right to change the Terms and Conditions and prices of the Products without advance notice. A notice of the changes is published in the Online Shop. Transactions are made at the prices and other terms displayed for the Customer at the time of the transaction.

9.4. The Seller has the right to abandon an order if the price of a Product displayed in the Online Shop was incorrect due to a technical error.


10. Other Terms and Conditions

10.1. Any disputes arising between the Customer the Seller will be resolved by negotiations. In case of failure to reach agreement, the Customer has the right to turn to the Consumer Disputes Committee.
